Terms of Service

These Terms of Service ("Terms") are an agreement between you and WS Tech LLC ("Wentswell," "we," "us"), 7533 Center View Court, STE R, West Jordan, Utah 84084, USA. By creating an account or using the Wentswell app or wentswell.com, you agree to these Terms and to our Privacy Policy.

1. The service

Wentswell helps people create social events, get matched with participants, chat, and meet up in person. We may add, change, or remove features at any time.

2. Eligibility and your account

You must be at least 18 years old to use Wentswell. You are responsible for your account and for keeping your credentials secure. Provide accurate information and keep it up to date.

3. Your content

You keep ownership of the content you post (event details, photos, messages). You grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content as needed to operate the service — for example, showing your event to potential participants. You are responsible for your content and must have the rights to share it.

4. Inviting others

Hosts may invite people to private events by selecting contacts from their phone. By sending an invitation, you confirm that you personally know the invitee and believe they would welcome it. Wentswell sends at most one text message per invitation on your behalf. You may not use invitations to spam, harass, market to, or otherwise message people who would not want to hear from you. We may limit, suspend, or block invitation privileges to prevent abuse.

5. Text messaging terms (Wentswell SMS program)

  • Program: Wentswell event invitations. A text is sent only when an existing Wentswell user invites your phone number to an event.
  • Message frequency: one message per invitation. No recurring or promotional messages.
  • Message and data rates may apply.
  • Opt out: reply STOP to any message to unsubscribe; you will receive no further texts from Wentswell. Reply HELP for help, or contact whuff@wentswell.com.
  • Carriers are not liable for delayed or undelivered messages.
  • Mobile information is handled as described in our Privacy Policy and is never shared with third parties or affiliates for marketing or promotional purposes.

6. Acceptable use

You agree not to:

  • Harass, threaten, defraud, or impersonate others;
  • Post content that is illegal, infringing, hateful, or sexually exploitative;
  • Use the service to send spam or unsolicited commercial messages;
  • Scrape, reverse engineer, or interfere with the service or its security;
  • Use Wentswell for any unlawful purpose.

We may remove content or suspend or terminate accounts that violate these Terms.

7. Meeting in person — assume the risk

Wentswell connects people who then meet in the real world. We do not screen, vet, or background-check users, and we are not responsible for the conduct of any user, online or offline. Use good judgment: meet in public places, tell someone where you're going, and leave any situation that feels unsafe. You are solely responsible for your interactions with other users.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, secure, or error-free, or that events will occur as described.

9. Limitation of liability

To the maximum extent permitted by law, WS Tech LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or related to your use of the service — including interactions or meetings with other users. Our total liability for any claim will not exceed the greater of $100 or the amount you paid us in the twelve months before the claim.

10. Indemnity

You will indemnify and hold harmless WS Tech LLC from claims arising out of your content, your use of the service, or your violation of these Terms or of any law or third-party right.

11. Termination

You may stop using Wentswell and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Sections 3 and 7–13 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Salt Lake County, Utah, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will update this page and revise the effective date, and where appropriate notify you in the app. Continuing to use the service after changes take effect means you accept the updated Terms.
